Terms and Conditions*

This “Terms and Conditions” agreement constitutes a legally binding offer from Sole Proprietor Alina Zakrevska (hereinafter referred to as the “Licensor”) to enter into an agreement for the provision of informational services under the terms and conditions set forth below. Please read this User Agreement carefully before using the Service. If you do not agree with these Terms and any related Binding Documents referenced herein, or if you are not authorized to enter into such an agreement, you must immediately discontinue any use of the Service.

  1. General Provisions

    1. Definitions:

      1. Service – a combination of software and hardware functionality owned by the Licensor, including the Website and Content, to which the User is granted access for educational and informational purposes.

      2. Website – an automated educational platform accessible via the Internet at https://pauker-club.com/, including all subdomains.

      3. User – you, or another individual on whose behalf you accept this Agreement in accordance with applicable law.

      4. Content – any informational or educational material, including but not limited to text, graphics, audio, video, and other materials accessible through the Service.

      5. Courses – educational resources available to the User through a paid subscription, including video lessons, written explanations, and supplementary materials.

      6. Exams – knowledge assessment services. One-time access to an exam is granted upon full payment by the User.

      7. Products – any digital or physical educational goods, such as books, textbooks, guides, and other instructional materials.

      8. User Account (User Profile) – a personalized section of the Website, accessible only by entering a login and password known solely to the User.

      9. Payment Service – a web-based interface enabling payments and fund transfers via mobile, Internet, and credit/debit cards globally.

    2. By using the Service in any way, including but not limited to:

      1. Viewing Content;

      2. Registering a User Account;

      3. Subscribing to the Website's services (including Course access);

      4. Placing orders for services (including Examinations);

      5. Purchasing Products (including books, materials, and related goods);

      6. Contacting the Website’s support using the provided contact information.

    3. By utilizing any of the above-mentioned features of the Service, you acknowledge and confirm that:

      1. You have read and fully understood the terms of this Agreement and any associated Binding Documents before using the Service.

      2. You unconditionally accept all terms of this Agreement and the referenced Binding Documents and agree to comply with them or discontinue using the Service.

  2. General Terms of Use

    1. The following document is a Binding Document and an essential condition of this Agreement:

      1. The Privacy Policy, which outlines the rules for handling and using confidential and personally identifiable information.

    2. The Licensor reserves the right to impose technical limits on the use of the Service and will inform Users accordingly, at its sole discretion.

    3. The User must utilize the latest available software versions on their computer or mobile device. The Licensor cannot guarantee quality of service otherwise.

  3. Limitations

    By accepting these Terms, you acknowledge and agree that:

    1. Consumer protection laws do not apply to the relationship between the Parties under this Agreement.

    2. The Service is provided for educational purposes "as-is", with no warranties that it will meet your expectations or be uninterrupted, timely, secure, or error-free.

    3. If the User misuses the Service, the Licensor may cancel paid services. In such cases, the Licensor will refund prepaid amounts minus a 25% fee to cover expenses.

    4. The Licensor may restrict or revoke access to the Website or parts thereof if Terms are violated.

    5. If the User is inactive for over 12 months, the Licensor reserves the right to delete their account.

    6. As the Service is continuously updated, its form and features may change without notice. The Licensor may suspend or terminate services to all or specific Users at any time.

    7. The User shall not: copy, emulate, decompile, disassemble, or otherwise reverse-engineer the Service; nor use it to create derivative works or competing services without the Licensor’s prior written consent.

    8. The service is considered rendered once the User gains access to the Content. No refunds are issued post-access.

  4. Account Registration

    1. To access certain features, the User must register, creating an account with access to their User Profile.

    2. The User represents and warrants that all actions performed on the Website under their credentials are performed by the account holder.

  5. Orders and Payment

    1. Registered Users may order and pay for the following services:

      1. Subscription-based access to Courses;

      2. Participation in Examinations.

    2. Payments for Services and Products are processed via the Payment Service, or by direct wire transfer to the Licensor’s account as listed on the Website.

    3. Payment is deemed complete upon receipt of funds or confirmation from the Payment Service.

  6. Notifications

    1. The User consents to receive notifications from the Licensor via email or phone number (including associated messaging apps) provided during Service usage.

    2. Notifications may include updates, changes to Terms, or promotional information.

  7. Miscellaneous

    1. The Licensor may unilaterally amend or terminate this Agreement at any time without notice or liability, per Section 3.3.

    2. Service interruptions may occur due to scheduled maintenance or technical issues, with or without prior notice.

    3. This Agreement is governed by the laws of Ukraine.

    4. Parties shall endeavor to resolve disputes amicably; otherwise, the matter will be resolved in Ukrainian courts under applicable law.

    5. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
